Welcome to Taggs. These Terms & Conditions ("Terms") are a legal agreement between you and Taggs Health LLC ("Taggs," "we," "us," or "our"), governing your access to and use of www.taggs.co and any related applications, features, and content (collectively, the "Platform" or "Services"). By accessing or using the Platform, creating an account, or clicking "I agree," you accept these Terms. If you do not agree, do not use the Platform.
1. Eligibility
You must be at least 18 years old, a resident of the United States, and legally able to enter into a binding contract to use the Platform. By using the Platform, you represent that you meet these requirements and that all information you provide is accurate, current, and complete.
2. Description of Service
Taggs operates a marketing and scheduling platform that connects users with independent, third-party licensed healthcare providers and facilitates fulfillment through Rush Pharmacy ("Pharmacy Partner"). Taggs does not provide medical advice, does not practice medicine or pharmacy, and is not a healthcare provider. Any clinical evaluation, diagnosis, treatment decision, or prescription is made solely by the independent Medical Group provider, in their own professional judgment, and is not directed, reviewed, or approved by Taggs.
Use of telehealth services requires your consent under our separate Telehealth Consent, which is incorporated into these Terms by reference and forms part of this agreement.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@taggs.co of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe present a risk to the Platform, other users, or Taggs.
4. Fees, Billing, and Cancellation
- Subscription fees charged by Taggs.
- Subscriptions renew automatically at the interval and price disclosed at checkout unless cancelled before the renewal date.
- You may cancel a subscription at any time through your account settings or by emailing support@taggs.co; cancellation stops future billing but does not entitle you to a refund of amounts already charged, except where required by law or separately stated in an applicable refund policy.
- We reserve the right to change fees prospectively with reasonable notice.
- By submitting payment information, you authorize Taggs, affiliate clinicians, or third-party payment processors to charge the amount due in accordance with their terms.
5. Medical Disclaimer
The Platform, and any general health content made available on it, is provided for informational and scheduling purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified clinician with questions about a medical condition. Reliance on any information provided through the Platform, other than information provided directly to you by your treating clinician during a visit, is solely at your own risk.
6. Third-Party Services
The Medical Group, the Pharmacy Partner, our intake technology vendor, payment processors, and other third parties referenced on the Platform are independent businesses, not owned or controlled by Taggs. Their services are governed by their own terms and policies, and Taggs is not responsible for their acts or omissions, including clinical decisions, prescribing decisions, or dispensing accuracy.
7. Prohibited Conduct
- Providing false or misleading information on intake forms.
- Using the Platform to obtain medication for anyone other than yourself.
- Attempting to access another user's account or data.
- Reverse engineering, scraping, or interfering with the Platform's operation.
- Using the Platform in a manner that violates any applicable law.
8. Intellectual Property
The Platform, including its design, text, graphics, logos, and software (excluding third-party content and clinical content owned by the Medical Group), is owned by Taggs or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Platform without our prior written consent.
9. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. TAGGS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY TREATMENT WILL BE EFFECTIVE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAGGS AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE PLATFORM OR ANY SERVICES OBTAINED THROUGH IT — INCLUDING ANY CLINICAL CARE PROVIDED BY THE MEDICAL GROUP OR MEDICATION DISPENSED BY THE PHARMACY PARTNER, WHICH ARE PROVIDED BY INDEPENDENT THIRD PARTIES. IN NO EVENT WILL TAGGS' TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO TAGGS (EXCLUDING AMOUNTS PAID TO THIRD PARTIES) IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold Taggs harmless from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Platform, or information you provide that is false or misleading.
12. Dispute Resolution and Arbitration
Except for disputes eligible for small claims court, you and Taggs agree to resolve any dispute arising from these Terms or the Platform through binding, individual arbitration rather than in court, and both parties waive any right to a jury trial or to participate in a class action. This section will be governed by the Federal Arbitration Act. You may opt out of this arbitration provision by emailing support@taggs.co within 30 days of first accepting these Terms.
13. Governing Law
These Terms are governed by the laws of the State, without regard to conflict-of-law principles, except where superseded by federal law or where your state's consumer protection laws provide otherwise.
14. Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms with an updated "Last Updated" date. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
15. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause. You may stop using the Platform at any time. Sections that by their nature should survive termination (including Sections 9–13) will survive.
16. Entire Agreement; Assignment
These Terms, together with our Privacy Policy, Consumer Health Data Privacy notice, Telehealth Notice, and Telehealth Consent, constitute the entire agreement between you and Taggs regarding the Platform. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
